Changes to the Mental Health Act 2007 meant that from April 2009, there is a legal duty on statutory bodies to provide this service. If you are detained under Section 2 or 3 of the Mental Health Act, have been conditionally discharged from Section 2 or 3, or are subject to a Guardianship Order or on a Supervised Community Treatment Order, you have the legal right to see an Independent Mental Health Advocate (IMHA). They can assist you with issues related to your care and treatment, appealing your section and help you to understand you legal rights and how to exercise them.
If you are in hospital as an informal patient you can also have the support of an advocate. If you are sectioned, an advocate can also help support you with other non-IMHA issues.
